Specifically: The administrative investigation revealed that during the time frame of January 2021 to October 2022 you did not conform to APD.SOP.3110 GCIC and NCIC by periodically running Ms. Kirsty Spivey’s information on a Mobile Data Terminal (MDT) to access information contained within the ACIC/GCIC system. You also ran Mr. Timothy Kelly’s information on a MDT to access the information within the ACIC/GCIC system at the request of Ms. Kirsty Spivey. It was also found; you ran a vehicle registration belonging to a Mr. Coggins on a MDT to access the information within the ACIC/GCIC system. All the above stated entries were made for personal
reasons and not Law Enforcement related.
APD.SOP.3110 states: 2. POLICY The Department will comply with GCIC rules and regulations. All Department employees will adhere to the procedures contained in this directive so that the Department can maintain access to GCIC/NCIC files. All information obtained through GCIC/NCIC will be used for official criminal justice business only. Employees found in violation of these policies will lose their
certification and be denied future access to the system and are subject to disciplinary action. (CALEA 6th ed. Standard 81.2.8) 4.1.1 NCIC files may be queried by certified operators for stolen property, wanted and missing persons, vehicle registrations, driver’s license checks, driver’s records and criminal
history checks. (CALEA 6th ed. Standard 74.1.3b)

Based on investigation 23-1-0214-SOP, Officer lan Applewhaite was sustained on
4.1.21 Personal Business and 4.2.33 Conformance to Directives (APD.SOP.3110 GCIC and NCIC Information). Based on the investigation, Officer Applewhaite violated these rules on multiple occasions on two different individuals by running names and vehicle registrations. These checks were done for personal, not professional use. Although there are no similar violations in his reckoning period, these violations are substantial and should be treated as such. Officer Applewhaite was transparent and honest about his lapse in professional judgment during his statements. APD.SOP.3110 (4.12.17) calls for immediate termination regarding these violations. For 4.1.21 Personal Business and 4.2.33 Conformance to Directives (APD.SOP.3110 GCIC and NCIC Information), the average suspension is two
days.
