“Piggy” Back Requests

What is a “Piggy” back request? A PBR is a request made for records that have already been requested for another requester. These records should be cheap as the redactions have already been made. We will also get a peek at what kind of records and what are they used for? A great way to learn of new records to get 🙂

50-18-71 (a) (b) (2) Any agency that designates one or more open records officers upon whom requests for inspection or copying of records may be delivered shall make such designation in writing and shall immediately provide notice to any person upon request, orally or in writing, of those open records officers. If the agency has elected to designate an open records officer, the agency shall so notify the legal organ of the county in which the agency’s principal offices reside and, if the agency has a website, shall also prominently display such designation on the agency’s website. In the event an agency requires that requests be made upon the individuals identified in subparagraph (B) of paragraph (1) of this subsection, the three-day period for response to a written request shall not begin to run until the request is made in writing upon such individuals. An agency shall permit receipt of written requests by e-mail or facsimile transmission in addition to any other methods of transmission approved by the agency, provided such agency uses e-mail or facsimile in the normal course of its business.

Dear Records Custodian,

Pursuant to the Georgia Open Records Act, O.C.G.A. § 50-18-70 et seq., I am formally requesting access to the following records:

Request:

I am seeking a comprehensive list of all individuals within your agency who handle or have responsibility for processing open records requests. This includes, but is not limited to, any individual who has access to, controls, or manages public records in any capacity — whether they respond to requests, make notes, follow up, or otherwise participate in the handling, review, or release of records.

This request specifically includes individuals who may respond to open records requests via email, or who have authority over any part of the process, regardless of their official title or role in your agency.

I am seeking a comprehensive list of all open records requests submitted to the Georgia Bureau of Investigation (GBI) by parties other than myself during the timeframe of January 1, 2024, through February 1, 2024. For each request, I am asking that the following information be provided:

  1. A description of the records requested.
  2. The name of the individual or entity that submitted the request.
  3. The associated fees or costs quoted for the fulfillment of each request.

I respectfully request that this information be provided in compliance with O.C.G.A. § 50-18-70 (a) (b) (2), which defines “public record” to include “all documents, papers, letters, maps, books, tapes, photographs, computer-based or generated information, data, data fields, or similar material prepared and maintained or received by an agency or by a private person or entity in the performance of a service or function for or on behalf of an agency or when such documents have been transferred to a private person or entity by an agency for storage or future governmental use.”

If any portion of this request is denied or records are withheld, I request that you cite the specific legal exemption under the Georgia Open Records Act justifying the denial, as well as provide the contact information of the individual responsible for the decision.

Please provide the records in electronic format (e.g., PDF, CSV) via email, if available, or let me know if the records will be provided in a different format or will require any fees. If there are any costs associated with this request, please notify me in advance.

Thank you for your time and attention to this matter. I look forward to your prompt response, in compliance with the statutory response time as mandated under the Georgia Open Records Act.

So you are denying this request? Just to be clear.

I am being forced to use their flawed portal!!

I then responded with this email

I received communication from Robin Gay “I am currently out of the office. If you require immediate attention please call 404-270-8527”

Someone at the GBI entered this request in their portal and closed the request stating it is not an open records request.

And the response from Cheryl Peyton herself as she was copied on the communication.
