Mississippi is an one party consent state pursuant to Miss. Code Ann. § 41-29-531(e). What that means is that at least one party in the conversation has to know it is being recorded

Here is the email request..

The Mississippi Department of Public Safety responds to your request dated August 18, 2023, as follows:

1.      1. All email, text, and telephonic communications pertaining to Mathew Fischer and James Fischer involving any supervisory personnel, including communications from or to Mr. Sean Tindell, the Commissioner of the Mississippi Department of Public Safety.

This information, to the extent that it exists, constitutes personnel records and attorney client privilege, which are specifically exempted from the provisions of the Mississippi Public Records Act. See Miss. Code Ann. §25-1-100(1) and Miss. Code Ann. § 25-1-102. We could locate no information outside of these two parameters responsive to this part of your request.

2.      A comprehensive list of all employees affiliated with your agency, detailing their names, ranks, and respective salaries.

See attached Excel spreadsheet entitled “AnnualCompensationDetails-All”.

3.      Furthermore, with respect to State Trooper Jason Young, I request:

1)     The first page of all documented use-of-force incidents.

This information, to the extent that it exists, constitutes personnel records, which are specifically exempted from the provisions of the Mississippi Public Records Act. See Miss. Code Ann. §25-1-100(1).

2)     The complete public complaint file.

This information, to the extent that it exists, constitutes personnel records, which are specifically exempted from the provisions of the Mississippi Public Records Act. See Miss. Code Ann. §25-1-100(1).

3)     The internal affairs or disciplinary file.

This information, to the extent that it exists, constitutes personnel records, which are specifically exempted from the provisions of the Mississippi Public Records Act. See Miss. Code Ann. §25-1-100(1).

4)     A detailed record of all arrests made by Trooper Young during his tenure with your agency, which some institutions may refer to as the “Arrest by Adult audit detail.”

The MS Dept. of Public Safety does not maintain a list of the data requested. Per MS Attorney General opinion, 2007 WL 4192036 (Miss. A.G.), the MS Dept. of Public Safety is under no obligation to create a list of information that does not already exist.

We have attached the information our system does produce. See attached Excel spreadsheet entitled “Jason Young eCite jailed search”. This spreadsheet is a list of all arrests by Trooper Jason Young since he has been a Trooper with the MS Highway Safety Patrol. The spreadsheet has not been redacted in any form. Please note that you will need to look at the date of arrest and the ticket numbers to determine if the arrest involved more than one ticket/citation. By doing so, this will yield that the number of arrests actually made is not equal to the number of tickets/citations listed. The number of arrests will be less than the number of tickets/citations listed.

Also add this email and label it as a complaint and place it in Robert Wentworths file, after this is escalated to a supervisor. That is also my request as Robert can’t obey laws.As far as my previous request and your violation of the open records laws, Redact the personal information! 25-61-5 (2) “the public agency shall redact the exempted material and make the nonexempted material available” 

Everyone knows their phone numbers and addresses are private,, that’s why you have to redact!

Go read the laws before you end up having to explain why you can’t read!

Chapter 61 – Public Access to Public Records
§ 25-61-5. Public access to records; written explanation required when records cannot be produced within specified time; form and retention of denials

*** (2) If any public record contains material which is not exempted under this chapter, the public agency shall redact the exempted material and make the nonexempted material available for examination. Such public agency shall be entitled to charge a reasonable fee for the redaction of any exempted material, not to exceed the agency’s actual cost.
