Lack of Assigned District Attorney:
I have been informed that Colin Foster, the former Assistant District Attorney handling my case, has transferred, leaving my case currently unassigned to any District Attorney. This lack of assignment has caused significant delays in the progression of my case.
Pending Open Records Requests:
Multiple Open Records Requests have been submitted, with the latest report received on February 25, 2025, still not providing the body camera footage from Officer Hope Moore and other assisting officers. This footage is crucial for my defense, and its continued withholding hampers my ability to prepare adequately.
Incident Details:
The charges against me involve an allegation of simple battery against Donita Robino, who was trespassing on my property at the time. Officer Hope Moore allowed six individuals to enter my home without court orders or my permission as the homeowner. Despite my attempts to present evidence that these individuals were neither occupants nor permitted on my property, Officer Moore disregarded due process and facilitated their entry. Subsequently, I was arrested based on false statements, and during my detention, personal belongings, including military items, were removed from my home.
Prolonged Evidence Withholding:
It has been nearly two years since my arrest, and essential evidence, particularly the body camera footage, remains undisclosed. This prolonged withholding suggests a misuse of the judicial system to conceal police misconduct and civil rights violations.
Specific Concerns Regarding Makisha Gann:
In July 2023, Makisha Gann vacated my residence after an altercation. She failed to update her address within the required timeframe and falsely claimed occupancy at my property, committing perjury. Locks were changed on July 14, 2023, by H & H Locksmith, and she was not provided a key. Witnesses, including my mother, Angela Kelly, can attest to her move-out. Despite this, she misrepresented her residency status to law enforcement.
Request for Resolution:
The ongoing delays and lack of transparency have caused undue hardship and raise serious concerns about the integrity of the proceedings. I respectfully request:
- Immediate Assignment of a District Attorney: To ensure my case proceeds without further delay.
- Release of Withheld Evidence: Prompt provision of all relevant materials, including the body camera footage from Officer Hope Moore and other assisting officers.
- Fair and Timely Trial: An expedited trial date to address the charges against me and allow me to clear my name.
I urge your office to address these issues promptly to uphold justice and prevent further infringement on my rights.
