August 2026: how the Flock misuse surfaced

The Hall County Sheriff’s Office said its internal audit found Atkins accessed its Flock Safety license-plate-reader system on at least four occasions for personal matters. The agency found no legitimate law-enforcement purpose for those accesses and terminated his employment August 24, 2026. CBS Atlanta and FOX 5 reported the termination and noted that the investigation remained open at the time.

At least four accesses is the number disclosed in initial reporting—not necessarily the complete search history. The public reports did not identify the searched plates, their owners, the user-entered reasons, or the underlying audit export. No motive beyond the Sheriff’s Office’s stated personal use should be assumed.

Georgia POST history: what the official profile actually shows

The Georgia POST certification profile preserved by SOS lists employment with the Georgia State Patrol from October 30, 2011, through May 3, 2012, with the separation marked “Terminated.” It lists Atkins beginning Hall County Sheriff’s Office employment on December 3, 2012. A POST investigation was opened ten days later on December 13 and recorded as closed or complete with a final action of “NO ACTION” on March 6, 2013.

The original SOS article states its reporter was informed that underlying records from that earlier inquiry had been purged. The reason for the 2012 investigation is not established by the profile alone, and the fact of a prior termination does not establish misconduct or connect it to the later Flock incident. A “No Action” disposition should not be described as discipline.

The profile generated August 27, 2026, reportedly still displayed “In Good Standing” and active certifications despite Atkins’s employment termination. Employment status and professional certification status are separate; a snapshot is not proof that certification remained unchanged afterward.

June 14, 2018: the fatal shooting of Joseph Villanueva

Atkins’s prior law-enforcement history includes an officer-involved shooting that is separate from the 2026 Flock case. On June 14, 2018, three Hall County deputies fired during an encounter on Ridgeway Drive in Gainesville, killing Joseph Villanueva, 29. Contemporary reporting identified Atkins, Kevin Lyle and Nathan Manley as the deputies involved.

The GBI’s contemporaneous preliminary report said deputies responded to a call about a man with a handgun. It reported that Villanueva fled an initial encounter, confronted another deputy while pointing a gun, and that evidence indicated he fired his weapon. The GBI reported the deputies fired and Villanueva died at the scene. The deputies were placed on administrative leave under normal protocol while the investigation proceeded. These are the investigating agency’s preliminary statements, not an independent adjudication of the shooting’s legality.

That official release did not identify Atkins as the officer who fired a particular shot, and the sources reviewed here do not establish a final prosecutorial finding or any individual disciplinary sanction stemming from the shooting. The shooting should not be portrayed as proof of wrongdoing.

Hall County’s wider Flock audit: seven personnel cases

By September 4, 2026, FOX 5 reported Hall County’s agencywide audit had reviewed 758 searches and flagged 85 as suspicious. The Sheriff’s Office identified seven employee policy cases: three terminations and four resignations. The personnel named in coverage included Justin Brown, Michael Atkins, Austin Scott Flanagan, Jason Orellana, Taylor McArthur, Melissa Wood and Brandon Sanders. These are separate employee matters; an agencywide suspicious-search total is not an individual count attributable to Atkins.

In a later development, the GBI announced on September 30, 2026 that it had arrested Justin Brown and charged him with two counts of misuse of a license-plate-reader system and two counts of violation of oath of office. Those charges concern Brown, not Atkins. The GBI described Brown’s investigation as active and ongoing.

What records could answer the remaining questions?

  • The complete Atkins Flock audit export, user access history, justification fields and relevant search timestamps, subject to lawful redactions
  • Atkins’s termination notice, disciplinary hearing record, Internal Affairs findings and any GBI referral
  • Current Georgia POST certification and separation records, plus retention/disposition documentation for the 2012–2013 inquiry
  • The GBI case file, prosecutorial review and final determination relating to the June 2018 shooting
  • Hall County ALPR access policies, audit schedule, training records and corrective measures

These requests would help determine what was established in each separate proceeding without treating an administrative firing as a criminal conviction or an earlier no-action POST case as evidence of wrongdoing.

Investigation status · October 9, 2026

The documented August 2026 termination is confirmed by contemporaneous reporting. The original Georgia POST profile establishes the historical employment and certification entries described above. The GBI confirms the separate 2018 shooting investigation and the September 2026 criminal case against Justin Brown. No verified criminal filing against Atkins or updated final POST action was identified in the sources reviewed for this edition.
