Good day,
I am requesting the following records per the Georgia Open Records Act
All body cam from the June 11, 2024 incident that happened at Chevy’s regarding a call from officer Gomez of the Harlem PD advising of a warrant for Richard Russells arrest. . 911 call from Harlem PD cop and CAD SHEET released by Augusta E-911 services (Was suppose to be exempt) 🙂
As shown in the screenshot below Augusta E911 released records that Walter McNeil of internal affairs for the Richmond County Sheriff’s Office states is exempt from disclosure due to pending prosecution. I guess the 91 call is not part of that!
The Georgia Open Records Act
He stated the incorrect exemption, he stated 50-18-71 (a) (4) which does not exist. However 50-18-72 (a) (4) does,
Records of law enforcement, prosecution, or regulatory agencies in any pending investigation or prosecution of criminal or unlawful activity, other than initial police arrest reports and initial incident reports; provided, however, that an investigation or prosecution shall no longer be deemed to be pending when all direct litigation involving such investigation and prosecution has become final or otherwise terminated
Harlem Police Department did issue a warrant for Richard Russell
The Columbia County superior court dismissed the warrant against Richard Russell on 6.13.24
My request was made on June 28, 2024.
Potential 1A and open records violation Richmond County Sheriff’s Office
Good day, I am asking for a review of my request to ensure the open records laws are being followed. I have been told by Walter McNeil that there is an investigation involving the June 11, 2024 body cam where Harlem PD called RCSO to assist in locating Richard Russell. There is no pending litigation in Harlem or Columbia County. There is no proof of any investigation regarding Russell as he was not arrested June 11, 2024. I am requesting the body cam from the June 11 incident from all officers:

6.10.24 Warrant issued by Harlem Police department for Richard Russells arrest
6.11.24 (Downtown Augusta) Harlem PD located Russell and called August 911 to report that Richard Russell needed to be apprehended on a Warrant issued by HPD
6.13.24 Superior Court of Columbia County dismissed the HPD warrant on Russell
6.27.24, I requested the CAD sheet and 911 call made by HPD from August E911
6.28.24 The records from Augusta E911 released, 1 911 call and 1 cad sheet
6.28.24 The body cam from the June 11, 2024 incident where the Richmond County Sheriff’s office responded to the HPD 911 call was requested
July 3, 2024 Richmond County Sheriff’s Office Walter McNeil denied the body cam request. He stated the exemption, he stated 50-18-71 (a) (4)
July 3, 2024 I requested proof there was an investigation involving the Richard Russell June 11, 2024 incident
Request ignored.

Please assist in this request. This is preventing me from publishing a news story. Thus is a potential 1st amendment violation under the Freedom of press and is also a potential open records violation. Is Richard Russell being prosecuted? Please release the body cam.
