On Friday, December 11, 2015, Special Agent APRIL GRIFFITH received an email from ELIZABETH YORK, who is an Assistance District Attorney with the Bartow County District Attorney’s Office in Cartersville, Georgia. 

AGENT GRIFFITH had previously submitted a copy of this case file to the DA’s office for them to review to determine what, if any, criminal offenses had been committed and whether to go forward with prosecution. The email received from ADA YORK stated that the DA’s office had decided that there was not sufficient evidence that a crime had been committed so they were electing at this time to not pursue anything further but if more evidence or victims could be identified then it would be revisited. A copy of this email will be attached to this summary.

On Thursday, October 30, 2014, at approximately 2:35 PM, Special Agent APRIL WELLS conducted an interview with Emerson Police Department OFFICER ADAM ROGERS concerning an incident which had occurred involving former police officer DAMON BOSWELL. OFFICER ROGERS stated the following:

OFFICER ROGERS stated that he was at the Wal-Mart vision center in Cartersville, Georgia talking with his cousin who works there. OFFICER ROGERS stated that RYAN MATHIS also works there and asked if OFFICER ROGERS worked at Emerson Police Department. OFFICER ROGERS stated that he told MATHIS that he did work at the police department. OFFICER ROGERS stated that MATHIS told him that he had been issued a ticket by OFFICER BOSWELL for speeding and wanted to know if OFFICER ROGERS could talk to OFFICER BOSWELL about reducing the ticket. OFFICER ROGERS stated that he would talk with OFFICER BOSWELL.

OFFICER ROGERS stated that when he left the Wal-Mart vision center he called OFFICER BOSWELL and asked him if he would be willing to reduce a ticket he wrote to RYAN MATHIS. OFFICER ROGERS stated that OFFICER BOSWELL asked him if MATHIS worked at the Wal-Mart vision center and OFFICER ROGERS replied yes. OFFICER ROGERS stated that OFFICER BOSWELL then told him that if MATHIS could get him some free eye contacts for his wife then OFFICER BOSWELL would reduce his ticket. OFFICER ROGERS stated that he told OFFICER BOSWELL not to worry about it. OFFICER ROGERS stated that OFFICER BOSWELL then said that he would talk to MATHIS himself and asked for MATHIS’ phone number. OFFICER ROGERS stated that he gave MATHIS’ phone number to OFFICER BOSWELL and he was not involved in the situation anymore after that.

OFFICER ROGERS stated that later that day he talked to OFFICER BARNES who said he relieved OFFICER BOSWELL. OFFICER ROGERS stated that OFFICER BARNES told him that OFFICER BOSWELL had a large box of eye contacts in his patrol vehicle and OFFICER BOSWELL told OFFICER BARNES that he got the eye contacts for free for his wife in exchange for reducing a ticket.

OFFICER ROGERS stated that he was talking with ALLEN RIDER one day and MR. RIDER told him that he had gotten his daughter’s ticket reduced to a warning by OFFICER BOSWELL because he put brakes on BOSWELL’s wife’s vehicle for no charge. OFFICER ROGERS stated that MR. RIDER later changed his story saying that BOSWELL did pay for the brakes once MR. RIDER realized that BOSWELL might get in trouble. Nothing further at this time.
